What Is RERA and How It Protects Property Buyers in India

What Is RERA?

The Real Estate (Regulation and Development) Act, 2016 — commonly known as RERA — is a landmark Indian legislation designed to protect homebuyers and bring transparency to real estate transactions. It mandates that all commercial and residential projects above 500 sq. meters or 8 apartments must be registered with the respective state RERA authority before marketing or sale.

Why RERA Matters for Buyers

Before RERA, property buyers had limited recourse against delayed projects, false advertising, or arbitrary price changes. RERA addresses these issues by enforcing:

  • Mandatory project registration — Developers must register projects before advertising or selling. Unregistered projects face heavy penalties.
  • Carpet area transparency — Pricing must be based on carpet area (not super built-up area), eliminating misleading pricing practices.
  • 70% escrow mandate — Developers must deposit 70% of project funds in a dedicated escrow account, ensuring money is used for construction, not diverted.
  • Defect liability period — Developers are liable for structural defects for 5 years after possession. Repairs must be completed within 30 days.
  • Timely delivery — Delayed projects entitle buyers to compensation or a full refund with interest.

How to Verify a RERA Registration

Each state has its own RERA portal. To verify:

  1. Visit your state's RERA website (e.g., maharera.mahaonline.gov.in for Maharashtra)
  2. Search by RERA registration number or project name
  3. Check registration validity dates, project timeline, and complaint history

On Clear Title Properties, we collect RERA numbers during agent and developer onboarding and plan to manually verify them against state portals.

Which States Have Active RERA?

All Indian states except Nagaland have notified RERA rules. However, implementation quality varies significantly:

  • Strong implementation: Maharashtra, Uttar Pradesh, Karnataka, Tamil Nadu, Haryana
  • Moderate: Gujarat, Rajasthan, Madhya Pradesh, West Bengal
  • Developing: Northeastern states, smaller UTs
