Welcome to Clear Title Properties (the "Platform" or "Service"). By accessing or using our Website or Mobile Application, you agree to comply with and be bound by these Terms of Use.

1. Our Role as an Intermediary

Clear Title Properties is a digital real estate advertising and information platform. We are an Intermediary as defined under the Information Technology Act, 2000. We provide a platform to connect buyers, sellers, tenants, landlords, and RERA-registered agents. We are not a real estate broker, nor do we charge brokerage commissions on transactions.

We do not facilitate, negotiate, or assist in the final sale or lease of any property. Any transaction completed is strictly between the involved parties.

2. User Generated Content & Disclaimers

The Platform heavily relies on "Self-Reported" data uploaded by users (Sellers, Developers, Agents). While we employ flat fees to deter spam, Clear Title Properties does not independently verify the authenticity, title, or physical conditionof properties listed on the platform unless explicitly marked with an "Agent Verified" badge (which represents the independent findings of a third-party RERA agent).

• You must conduct your own independent checks and establish the authenticity of any property, its title, and its legal status (e.g., RERA compliance, OC/CC availability).
• We strongly recommend conducting proper due diligence prior to entering into any financial transaction. Beware of false title documents or disputed properties.
• Clear Title Properties shall not be held liable for any inaccuracies, false claims, or financial losses incurred by relying on user-generated content.
• In-App Messaging: The Platform provides a direct messaging feature for communication between Users. All messages are User Generated Content. The Platform does not proactively monitor or censor private chats. However, to comply with the Information Technology (Intermediary Guidelines) Rules, 2021, the Platform reserves the right to execute a 3-hour admin takedown of any chat and suspend the offending user's account upon receiving a valid grievance or court order regarding unlawful, fraudulent, or harassing messages.

3. Pricing, Payments & Refund Policy

Clear Title Properties operates a transparent flat-fee model for platform services. All fees listed below represent Introductory Promotional Rates. Payment processing is facilitated through our authorized payment aggregator partner, Razorpay Software Private Limited.

• Direct Owner Listings: Founder Beta Pass grants up to 5 properties 100% Free (₹0) to publish and ₹0 to chat with interested buyers (valid 60 days per listing). Subsequent listings post-quota are charged a flat ₹25.
• Buyer Access Pass: 100% Free (₹0) during launch liquidity phase for 180-day direct in-app messaging and verified contact reveals.
• RERA Agent Onboarding: Complimentary early beta access for verified RERA-registered agents (standard ₹49 annual fee waived for early partners).
• Developer Onboarding: Held at ₹0 Complimentary Early Beta during traffic ramp-up (standard ₹999/yr subscription on hold).

Promotional Pricing Notice: All fees are introductory launch rates and may be adjusted or updated by the Platform with prior notice.

Refund & Cancellation Policy: Fees paid for digital listing publication, in-app chat initiations, and profile verifications are non-refundable once the service is rendered. In the event of duplicate transactions, payment gateway errors, or unfulfilled service requests, refunds will be initiated within 5 to 7 business days back to the original payment source (UPI / Bank Account / Card) via Razorpay.

4. Prohibited Conduct

You agree not to use the Platform to:

• Masquerade as a property owner if you are actually a broker (doing so will result in an immediate, non-refundable ban).
• Post properties that you do not have the legal right to advertise.
• Upload offensive, defamatory, or illicit content.
• Scrape, crawl, or mass-download data from the Platform without prior written consent.

5. Account Suspension & Termination at Platform Discretion

Clear Title Properties reserves the right, at its sole discretion, to suspend, deactivate, or permanently terminate any user account (Individual, Associate, or Developer) without prior notice or liability if:

• You breach any provision of these Terms or engage in fraudulent, misleading, or illegal activities.
• You post counterfeit property documents, fake titles, or misrepresent property attributes.
• A broker or agent attempts to masquerade as an individual owner to evade platform guidelines.
• Excessive complaints, chargebacks, or legal disputes arise in connection with your account.

Upon account termination, your right to use the Platform immediately ceases, listed inventory will be deactivated, and any listing or subscription fees paid are non-refundable and forfeit.

6. Indemnification & Liability Waiver

You agree to defend, indemnify, and hold harmless Clear Title Properties, its officers, directors, employees, and affiliates from and against any claims, losses, damages, liabilities, fines, or legal expenses (including reasonable attorney fees) arising out of your use of the Platform, your property listings, or your violation of any third-party rights or Applicable Laws.

8. Dispute Resolution & Jurisdiction

Any disputes arising out of the use of this Platform or payment transactions shall be governed by the laws of India and subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra, India.
